Agreement to Terms

By accessing or using insightAI's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

Use License

Permission is granted to access and use insightAI's services for personal and commercial purposes in accordance with your subscription plan. This license shall automatically terminate if you violate any of these restrictions.

Under this license you may not:

• Modify or copy the materials or services
• Use the materials or services for any commercial purpose or public display
• Attempt to reverse engineer any software contained in our services
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or mirror the materials on any other server

User Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You agree not to disclose your password to any third party.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the services in any way that violates any applicable law or regulation
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the services
• Use the services to transmit any advertising or promotional material without our prior written consent
• Impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
• Engage in any automated use of the system, such as using scripts to send comments or messages

Intellectual Property

The services and their original content, features, and functionality are and will remain the exclusive property of insightAI and its licensors. The services are protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

Subscriptions and Payments

Some parts of the services are billed on a subscription basis. You will be billed in advance on a recurring basis according to your chosen billing cycle.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. You are responsible for payment of all such taxes, levies, or duties.

Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to the services until the end of your current billing period. We do not provide refunds for partial subscription periods.

Engagement Rate Guarantee

New customers on their first paid billing cycle (Creator or Business plan) are eligible for our engagement rate guarantee, subject to all of the following conditions:

• You must connect at least one social account and keep it actively syncing for the full 30-day period following your first payment. This guarantee does not apply if your connected account is disconnected or sync is paused for more than 3 total days during the period.
• You must publish at least 5 posts on the connected account during the 30-day period, including at least 1 post in the first 7 days and at least 1 post in the final 7 days.
• You must actively use InsightAI during the 30-day period — at minimum, viewing 2 or more weekly AI summaries or having 3 or more interactions with the AI assistant. This guarantee is intended for customers who engage with our recommendations, not accounts that connect and remain inactive.
• "Growth" is measured by comparing your average engagement rate over the first 7 days of the period to your average engagement rate over the last 7 days. For this comparison only, both periods use your follower count as of day 1 of the 30-day period as the denominator, so follower growth during the period does not itself reduce your measured engagement rate.
• To request a refund under this guarantee, click "Contact Us" at the bottom of our landing page within 7 days of the 30-day period ending. We will verify eligibility against your account's synced data; claims are not accepted based on self-reported numbers.
• If eligible, we will refund the most recent billing charge only. This guarantee may be redeemed once per customer and once per connected social media account, whichever limit is reached first.
• Initiating a chargeback or payment dispute for the charge in question forfeits eligibility under this guarantee.

Disclaimer

The services are provided on an "as is" and "as available" basis. insightAI makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Limitations of Liability

In no event shall insightAI or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the services, even if insightAI or an authorized representative has been notified orally or in writing of the possibility of such damage.

Termination

We may terminate or suspend your account and bar access to the services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Utah.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the services after any such changes constitutes your acceptance of the new Terms.

Third-Party Integrations

Our services allow you to connect third-party platforms including Meta (Facebook and Instagram) and Google. When you connect these accounts, you authorize insightAI to access data from those platforms on your behalf using OAuth. Your use of these integrations is also subject to the respective terms of service of those platforms:

We store the access tokens necessary to retrieve your analytics data. We do not sell or share your third-party account data with any other parties.
